Terms and conditions
APPLICABILITY
These general terms and conditions apply to all agreements between you and Eastbound Gym, under which you can come and train with us. Once you have agreed to the general terms and conditions, they also apply to future memberships at Eastbound Gym.
The individuals associated with Eastbound Gym may also rely on these general terms and conditions. An associated person is understood to be: the employees, partners, and trainers of Eastbound Gym.
Eastbound Gym reserves the right to change the Terms of Use at any time (unilaterally). If this involves a significant change, you are free to terminate the agreement under which you can train with us. In the event of a change in the general terms and conditions, Eastbound Gym will ensure that you can take note of the latest version of the general terms and conditions and that you can save them.
If we make agreements after you have agreed to the general terms and conditions, and one of these agreements conflicts with a provision from the general terms and conditions, our agreement prevails. The provision from the general terms and conditions is then set aside.
REGISTRATION
You can register for a membership by filling out the registration form on-site or by signing up for a subscription online. Your registration is only complete once you have also signed the general terms and conditions in agreement.
If you are under 16 years old, you can only register with the consent of one of your parents.
You are responsible for the accuracy of the (personal) data you provide us for the registration. Consequences of inaccuracies are therefore at your own expense and risk.
Eastbound Gym is free to reject a membership application. A reason for Eastbound Gym to do so could be that we find it unwise for you to train with us due to your health.
RATE AND PAYMENT
When you register, you indicate which membership you choose and agree to the corresponding rate.
If we adjust the applicable rate, we will always ask for your agreement. If you do not agree, you are free to cancel your membership.
The payment of the membership fee is made by means of a direct debit. When you register, you give us permission to do so. The amount is paid in advance and is deducted around the first of the month.
During your membership at Eastbound Gym, you must have a card. This costs €5,-. If lost or stolen, you must purchase a new one.
MEMBERSHIP, MODIFICATION, AND CANCELLATION
The desired membership is entered into for at least three months. After the three months expire, your membership is automatically renewed.
For the first three months, you cannot change the membership. After that, you can change it every month. If you send an email to balie@eastboundgym.nl with your desired change by the 24th of the month at the latest, the change will take effect on the 1st of the following month (unless you want the change to take effect on a later date).
The above also applies to the cancellation of the membership. In other words, you cannot cancel the membership during the first three months. After that, you can cancel the membership every month by sending an email to balie@eastboundgym.nl with your name, the cancellation, and the reason for cancellation by the 24th of the month at the latest. The cancellation will then take effect on the 1st of the next month (unless you want the cancellation to take effect on a later date).
If you took advantage of the January 2023 promotion with a free personal training session, you entered into a one-year contract. You can also cancel this contract (before the 24th of the month for the next month) within this year; however, you agree that the personal training valued at €65 must be refunded to Eastbound Gym.
Eastbound Gym can terminate your membership immediately if you misbehave during training, for example by using disproportionate strength while sparring, using verbal violence, or displaying other types of behavior that do not belong in the safe and sporting environment we want to provide for our members. We consider it very important that everyone feels comfortable while training. If we terminate the membership, we do not owe you any compensation.
By entering into the membership, you also agree to our no-show policy. After being absent three times OR canceling within 2 hours of the relevant class, a fine of €10 will be charged. Then, for each subsequent absence, a new fine of €10 will apply.
RESERVING AND CANCELLING CLASSES
Eastbound Gym works with the online portal of Virtuagym and the corresponding Virtuagym App. As a member of Eastbound Gym, you are required to reserve classes through this portal or the App and check in with your card at the desk prior to the class.
If you decide not to attend the class, you must cancel this class yourself via the portal or the App. If you do not do this, Eastbound Gym will register you as absent. After being absent three times, Eastbound Gym will charge a fine of €10. After this, every new absence incurs a new fine of €10.
You give Eastbound Gym permission to use your email address to send you news about Eastbound Gym.
RISK AND LIABILITY
Eastbound Gym is in no way responsible or liable for damage or loss of your belongings that you bring when you come to train.
You come to train with us entirely at your own risk. Eastbound Gym is not liable under any (legal) grounds for any form of damage or injury arising before, during, or after training at Eastbound Gym.
Any liability of Eastbound Gym is limited to the amount that Eastbound Gym's insurance pays out in the event.
Eastbound Gym is never liable for indirect damage, including but not limited to: consequential damage, lost salary, lost profits, and damage due to business interruption.
A liability claim directed at Eastbound Gym does not suspend your obligations under the membership. In other words, if you hold Eastbound Gym liable, you remain obliged to fulfill your payment obligations.
HOUSE RULES
We have a number of house rules that we ask you to adhere to. They are displayed in the gym so you can always see or read them.
APPLICABLE LAW IN CASE OF DISPUTES
Dutch law applies to the general terms and conditions and everything related to them.
Disputes regarding the general terms and conditions or the agreements we make with each other and everything related to them or arising from them will be submitted to the competent court in Amsterdam.
